By tradition, the minister will be chosen Joaquim Barbosa, rapporteur of the case mensalão and current vice-president of the Supreme. Barbosa, however, should only take charge in November. The vice president of the court shall be the statutory process mensalão, Ricardo Lewandowski.
A succession of command follows the order of seniority; ministers choose the oldest member of the court and the second oldest becomes the vice. The criterion makes the current vice always be the next president. Whoever ends the mandate goes to the end of the queue, to enable switching.
The election must be rapid and occur before the start of session for the trial of the monthly allowance.
Barbosa takes only in November, when the current president of the court, Justice Carlos Ayres Britto, only compulsorily retire upon completing 70 years. No exact date for the inauguration.
